Prostitution Laws

Canadian Prostitution Laws
Prostitution (meaning the exchange of sex for money or other goods) in Canada is legal. However the laws in Canada regarding prostitution make it almost impossible to work legally. There are four sections of the Canadian Criminal Code that directly relate to prostitution.

Section 210 - Keeping a common bawdy house

This means you cannot work in, or be found in a bawdy house, you can also be charged or arrested if you knowingly let a place be used for the purpose of prostitution. Sex workers homes, hotels, massage parlours, and cars can all be considered a bawdy house under this section.

Section 211- Directing or taking someone to a bawdy house
You can not give directions to, or take any person to a place where prostitution is occurring (this includes hotel concierge, taxi drivers, etc).

Section 212- Procuring prostitution or living on the avails
Procuring means you can not talk a person into accessing services offered by a sex trade worker. You can not profit from the prostitution of someone else.

Section 213- Communicating for the purposes of prostitution
It is illegal to communicate in any public place for the purposes of prostitution. You can not negotiate services, price or location in a public place with a client. It is also illegal to stop cars or people on the street.
